Debt Calculations

- OVERVIEW
The purpose of this policy is to provide staff and members of the public a working knowledge of when a debt calculation is performed using the Debt Recalculation Utility Calculator (DRU).
- APPLICABILITY
This policy applies to all Arizona IV-D program staff performing Title IV-D services.
- POLICY
DCSS shall ensure the arrearage balances on debts are correct, whether the debts are based upon an Arizona order or an order from another jurisdiction.
The arrears calculation is completed through the end of the previous month.
DCSS and Arizona IV-D program staff shall be the final administrative authority in settling questions/issues when determining arrears.
A Statewide arrearage calculator was developed using an automated transfer of data from the clearinghouse and the child support case registry. The arrearage figure produced by the arrearage calculator is presumed to be the correct amount of the arrearage.
- CRITERIA
- DCSS shall calculate debts when:
- A new case with court orders is added to ATLAS.
- A new support order is added to a case.
- A Waiver of Arrears is received.
- An Affidavit of Direct Payments is received.
- An arrears balance determination is needed prior to obtaining a judgment.
- Upon request from the custodial parent (CP), non custodial parent (NCP) or attorney.
- Upon request from Administrative Review, including a CP Complaint.
- Upon request from the Settlement program.
- For satisfaction of judgment.
- To verify the arrears are paid.
- When a calculation has not been completed in the last 12 months and the case is being prepared for closure.
If all criteria are not met, DCSS shall not calculate the debts with the DRU calculator
- PROCEDURE
This policy is supported by staff procedures, which identify how action related to this policy will be conducted, including responsibilities, time frames, and required actions.
